Terms of Service

1.Agreement

These terms are an agreement between you and ask.ai, which runs ask.ai (tryask.ai). By creating an account or using ask.ai you accept them. If you use ask.ai for a company, you confirm you can accept these terms on its behalf, and "you" includes that company.

2.The service

ask.ai lets you create online forms, including with help from AI, share them, collect responses and send those responses to other tools. We may add, change or remove features over time. If we remove something important from a paid plan, we'll tell you in advance.

3.Accounts

• You must be at least 18 years old to create an account.
• Keep access to your email and Google account secure: anyone who can open your sign-in links can use your account.
• Workspace owners decide who joins their workspace. Members can see and change the workspace's forms and responses.
• Tell us right away if you think someone accessed your account without permission.

4.Your content

You own the forms you create and the responses they collect. You give us permission to store, copy, process and display that content only as needed to provide ask.ai to you, including sending it to the providers and integrations described in our Privacy Policy. We don't claim ownership of your content and we don't use it to advertise.

When you collect responses, you are responsible for them. That means telling respondents what you collect and why, having a lawful basis to collect it, handling their requests, and following the privacy laws that apply to you, such as the LGPD or the GDPR.

5.Acceptable use

You agree not to use ask.ai to:

• impersonate a person, brand or organisation, or trick people into sharing information (phishing);
• collect passwords, full card numbers or other credentials;
• collect sensitive data, such as health, biometric or financial data, without a lawful basis and the protections the law requires;
• send spam, or harass, threaten or discriminate against anyone;
• share illegal content, malware, or content that infringes someone else's rights;
• try to break, overload or get around the limits and security of ask.ai, or access other people's data.

We may remove content or suspend forms that break these rules, and we may report illegal activity to the authorities.

6.AI-generated content

ask.ai uses AI to suggest and write forms from your descriptions. AI can be wrong, incomplete or unsuitable for your situation. You are responsible for reviewing what it produces before you publish a form, and for the questions you choose to ask.

7.Plans and billing

• Free: up to 3 forms, 100 responses and 10 AI generations a month, for one person.
• Pro: $19/mo, billed monthly in advance through Stripe. It raises the limits (unlimited forms, 10,000 responses and 200 AI generations a month, up to 5 people) and unlocks the Pro features shown on our pricing page.
• You can cancel at any time from the billing page. Pro stays active until the end of the period you've paid for, and then your workspace moves to Free. Your forms and responses are kept; features that need Pro are paused until you upgrade again.
• Payments already made are not refunded, except where the law requires it.
• We may change prices. If we do, we'll tell you at least 30 days in advance, and the new price applies from your next billing period.

8.Third-party services

Some features connect to services we don't control, such as Calendly, Cal.com, Google Calendar, HubSpot, Salesforce, analytics tools and your own webhooks. Your use of those services is governed by their terms. We aren't responsible for them or for what they do with the data you send them.

9.Availability

We work to keep ask.ai available and your data safe, but the service is provided as it is and may sometimes be interrupted, for example during maintenance or because of problems with our providers. Keep your own copies of anything important; you can export responses as CSV at any time.

10.Suspension and closing an account

You can stop using ask.ai and ask us to close your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, puts others at risk, or doesn't pay. Unless the situation is urgent, we'll warn you first and give you a chance to export your data.

11.Liability

To the extent the law allows, ask.ai is not liable for indirect losses, such as lost profits, lost data or lost business, and our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that can't be limited by law.

If a claim is made against us because of your content or your breach of these terms, you agree to cover the reasonable costs that result, to the extent the law allows.

12.Governing law

These terms are governed by the laws of the country where the operator of ask.ai is established. If you are a consumer, you also keep the protections of the laws where you live.

13.Changes to these terms

If we change these terms, we'll update the date at the top. For important changes we'll let account holders know by email or in the app at least 30 days before they take effect. If you keep using ask.ai after that, the new terms apply.
